Terms & conditions
1. About these terms
These terms apply to the use of this website and to engineering services quoted or provided by Walker Engineering. Where a signed fee proposal or engagement agreement exists for a project, that document takes precedence over these terms to the extent of any inconsistency.
2. Scope of services
Engineering services are provided only for the scope set out in the accepted fee proposal for a project. Work outside that scope — additional design, revised drawings following client, architect or builder changes, or additional site attendance — is quoted separately before it is undertaken.
3. Information provided to us
Our design work relies on the accuracy of the information supplied to us, including architectural drawings, survey information, soil test reports and details of existing structures. Where information is unavailable, we will say so and state the assumptions made. If those assumptions prove incorrect, the affected design may need to be revised, and that revision is quoted as a variation under clause 2.
4. Fees and payment
Fees, inclusions and any disbursements are set out in the fee proposal for the project. Invoices are payable within 7 days of the invoice date.
Where an account remains unpaid beyond that period we may suspend further work on the project and withhold the issue of further documentation until the account is settled. We will tell you before we do so.
5. Drawings, documents and their use
Drawings, calculations, reports and certificates we issue are prepared for the nominated project and site only, on the basis of the information available for that site. They may not be reused for another project, another site, or a materially altered design.
Copyright in the documents we produce remains with Walker Engineering. On payment in full for the relevant stage, the client receives a licence to use those documents for the project for which they were prepared, including for building approval and construction.
6. Inspections
Site inspections are included only where the fee proposal says so. Where our engagement includes inspections, they are made at agreed stages and are not continuous supervision of construction. We do not direct, control or take responsibility for the builder’s means, methods, sequences or site safety.
Certification is issued on the basis of the design documentation we prepared and the inspections actually carried out.
7. Your obligations
Construction must follow the documentation we issue. Where site conditions differ from those documented, or a change is proposed on site, that change must be referred to us before the affected work proceeds. We are not responsible for work carried out contrary to our documentation, or for changes made without our review.
8. Limitation of liability
To the extent permitted by law, our total liability arising out of or in connection with the services — whether in contract, tort (including negligence), under statute or otherwise — is limited to the fees paid to us for the services giving rise to the claim.
To the extent permitted by law, we are not liable for indirect or consequential loss, loss of profit, loss of opportunity, or delay costs.
Nothing in these terms excludes, restricts or modifies any guarantee, right or remedy you have under the Australian Consumer Law or any other law that cannot lawfully be excluded.
9. Cancellation
Either party may end an engagement by written notice. If an engagement ends before completion, fees are payable for the work carried out up to that point, including work in progress.
10. This website
Information on this website, including our guides and articles, is general in nature and does not constitute engineering advice for any specific project. It does not take account of your site, your structure or your circumstances. No engineering advice should be relied upon until it has been given to you in writing for your project.
11. Privacy
Personal information you provide to us is handled in accordance with our privacy policy.
12. Governing law
These terms are governed by the law of the Australian state or territory in which the project site is located, and the parties submit to the non-exclusive jurisdiction of the courts of that state or territory. Where no project site is involved — including use of this website alone — the law of Queensland applies.
13. Changes to these terms
We may update these terms from time to time. The terms that apply to a project are those in force when the fee proposal for that project was accepted.
